Unfortunately it doesn't matter how they are usually shipped. UPS's packing guidelines rule here.
If Brooke can prove that 2 inches of foam would not have prevented the damage to the bike, then she has a claim with UPS.

When bike manufacturers ship bikes by UPS they do not add additional packing. They ship them just like they do on the pallets from Taiwan. And I know you can make a claim from a shop. (I don't know if you can actually get a recovery, but UPS will take a claim within a certain number of days of receiving the shipment.

It sounds like UPS did their job. UPS's policy stipulates a different packing method that the shipper used, i.e. 2 inches of foam. This information is easily accessible on UPS's website, as are the insurance terms. The shipper didn't follow UPS guidelines for packing the shipment. Therefore the damage is the fault of the shipper, not UPS. The shipper owes Brooke a new bike.

I am sad to hear that a person who not only trusted UPS with their shipment had their merchandise destroyed, but was also unable to receive a damage claim even after purchasing the optional insurance.
It would appear to me that it is unethical to offer shipping insurance if UPS representatives knew beforehand that they would deny a damage claim. Beyond the ethical issues, I hate to say it but I think it could also be a very legitimate claim for a class action lawsuit if this has happened a lot, which I would not be surprised to hear.
I have worked in many bike shops in my life, and if this is how UPS is going to treat an entire industry who uses its services, I would strongly suggest that the bike industry look for another carrier. It would not be difficult to copy the history of this claim as a letter to the editor for Bicycle Retailer and Industry news.
