For preventative measures I always carry pepper spray velcroed to my
stem.
I
think there are more dogs here in eastern Indiana than people.

There is an Oregon statute that prevents dog owners from allowing
their
animals to run at large. There is an Oregon court of appeals decision
which holds that the statute applies in a situation like yours. This
guy's dog was at large, he had notice that his dog liked to chase
cyclists and it chased you and caused you harm. Find a good
plaintiff's
attorney to file a claim and negotiate with the guy's homeowner's
insurer, assuming he has liability coverage. Mark Ginsberg comes to
mind. You have a remedy but whether it is worth the hassle to assert
it
depends on how badly you are hurt. Oh, and be sure to keep your
twisted
bike, smashed helmet, damaged clothing and take pictures of any
wounds.
Go to the doctor and get examined as well since you took a hard knock
to
the head.

Of course they can do something. You are a vehicle and the law covers
all vehicles including bicycles. I would not accept that at all. I
would call them back. They just do not want to get involved. Second,
report the dog to animal control, and third, contact the owner for
restitution and if you do not get a satisfactory response, file a
complaint in small claims court against the owner.

Subject: [OBRA Chat] a dog crashed me today.
On my ride a dog came shooting across the road. Ran into my front
wheel
. I
did a endo smashing my patch kit to smithereens with my back and broke
my
helmet with the back of my head on the road. ( lots of stars) so Im
sitting here with a killer headache, stiff neck, My back really hurts
and I
have a pain shooting down my left leg. And my fixed gear is totaled.
This
happened right in front of a guys house who saw the whole thing and
was
standing there looking down at me saying something. which turned out
to
be
are you okay. It took me awhile to figure out what he was saying as I
was
laying there. He said it wasn't the first time that dog had chased a
biker.
So I straightened my handle bars disconnected my front brake and rode
the
last few miles home which was kind of tricky because my front fork is
bent
about 25degrees to the right and the frame is twisted not to mention
the
huge wow in my front wheel . I called the Sheriff and they said they
couldn't do anything because It wasn't a motor vehicle biker accident.
Thank
God. Looks like Im out a bike a helmet and some medical bills. I guess
I
dont have anything to complain about Im not Dead or anything like
that.
Best, Peter
