I may be confused here, but when racers sign the standard OBRA waiver at each race, doesn't that prevent them from making future claims against OBRA's insurance policy if they get injured? How is it that a handful of people every year who have agreed not to go after OBRA if they get injured, do so anyway and risk ruining it for everyone?

Because OBRA is getting bigger and there is always that 2%......
