Re: Fwd: FW: Kruger Farm Stand Decision | Case NumberT2-09-002

Isn't there some recreational use angle that can be used? If the farm weren't directly earning revenue from the races (fees paid by the promoter and parking?) can the land be used for a recreational (race) purpose? Since the stand makes a lot of money on race days, the race might be also defined as a promotional activity -- as long, again, as the farm weren't earning direct revenue from the racing.

Here’s my crack at a simple solution.
We all “buy” $20 worth of pumpkins, gourds, or corn at the venue.

How would this be any different than
buying a pumpkin at ‘The Pumpkin Patch’ down the road in the Fall? They
have traffic and parking issues that eclipse the Kermesse series, they have
portable toilets to handle the crowds, they have tractor rides, they have food
vendors, and they have a farm animal petting zoo. These are all “promotional
activities and incidental sales” that get you there to buy their produce.

Can someone please explain the unique distinction?

back in college we didn't have a dry campus but you
couldn't sell alcohol on campus. we used to get around this by selling
punch cards. each punch on the card was worth one beverage.

something like this might be able to be used to get
around the "no fee" verbiage?

just
thinking out loud..........

maybe Portlang Racing could conduct a sitdown protest in the neighbor's driveway with the regular kermeese/cross crowd. Man!, cranky people drive me nuts!

This is discouraging because it's such a great venue for cross/kermesse. I hope they appeal. Would comments to the land use board do any good at this point?
