a refreshment on crazy drivers please.

Nicholas Perera

A few years ago, when I was 19, a VERY similar

incident happened to me. Upon calling the Portland

police, the officer told me he could do nothing, but

he told me that I should start carrying a gun while I

ride....

he drove by at about 50mph. missing me by less

than 12". slammed on his

brakes, jumped out and did a "try to scare me"

punch. my friend ended up

in

the ditch cause he turned around and saw how close

the guy was to us. then

the guy was all over in my friends face yelling

and doing more of his

pretend punches. i missed most of the

"conversation" when i was getting

the

cell phone out. i called home and left the plate

number and descriptions

on

my answering machine so i could call the sherrif

when i got home.

there were e-mails earlier this year regarding

what to do if you

encounter

 a

crazy driver. I had an incident yesterday, got

the license number along

 with

descriptions of both the truck and the guy. when

I called the sheriff I

 was

told it was freedom of speech and nothing could

be done.

Geeeeeee...

Last time I knew of this 'freedom of speech', you were 'allowed' to

defend

yourself and beat the living crap out of the moron! In ohter words, the

jag-off was making intimidations and threats which are hiss tough

cookies

if someone he attempted to intimidate beats the crap out of him.

I would suggest filing a complaint with the Sheriff's office. Hire an

attorney

(Calling Mark Ginsburg!). and go after the dumb-ass.

Just my $0.02 worth.

Uh, I'm not an attorney, and not really an authority on this stuff...

but isn't there a fairly serious misdemeanor called "Harassment" that

might apply here?

I believe the BTA has been helpful to cyclists confronted with this

kind of garbage... I also believe that there are several cycling

attorneys that would be willing to talk with you. Also, even if the

officer you talked to was reluctant to do anything (that was a pretty

interesting constitutional interpretation)... he might think

differently if he got a call from his county commissioner. (Yes, you

CAN call the local elected officials and sometimes get results)

It's called "intimidation". It's illegal and he can go to jail for it.

Either the sheriff you talked to was lazy or failed to state your case

accurately.
